This Privacy Policy explains how Piece & Quiet, LLC ("Company," "we," "us," or "our") collects, uses, discloses, and protects your personal information when you use our website Pieceandquietmarket.com (the "Site") and related services (collectively, the "Services"). This is an online marketplace facilitating the lawful listing and purchase of National Firearms Act (NFA) items, specifically silencers/suppressors, with transfers handled through licensed Federal Firearms Licensees (FFLs).

We are committed to protecting your privacy while complying with all applicable federal, state, and local laws, including firearms regulations and data protection requirements. This Policy is separate from our Terms of Service. By using the Site, you consent to the practices described here. If you do not agree, please do not use the Services.

1. Information We Collect

We collect the following categories of information:

Personal Information You Provide:

  • Account information: Name, email address, username, password, phone number.
  • Purchase and transaction data: Shipping details, selected FFL information, payment information (processed by third-party providers).
  • Communications: Inquiries, support requests, and messages with Sellers.
  • For NFA transactions: Limited information necessary to facilitate the transaction (full details below in Section 8).

Automatically Collected Information:

  • Device and usage data: IP address, browser type, device identifiers, operating system, access times, pages viewed, and referring URLs.
  • Location data: Approximate location derived from IP address (used to determine service availability and restrict access in prohibited states).
  • Cookies and tracking technologies: See Section 7 below.

Information from Third Parties:

  • Verification and compliance data from our service providers, such as our payment processor.
  • Information shared by Sellers or FFLs involved in your transactions.

2. How We Use Your Information

We use the collected information to:

  • Provide and operate the marketplace platform, including matching buyers with Sellers.
  • Process transactions and facilitate NFA transfers in compliance with ATF and other legal requirements.
  • Restrict access where NFA items cannot lawfully be transferred (for example, in prohibited states). Eligibility to purchase and possess NFA items — including the NICS background check — is verified by the licensed FFL(s) handling the transfer (including your receiving FFL), not by Piece & Quiet.
  • Communicate with you about accounts, purchases, updates, and customer support.
  • Improve the Site, analyze usage, and personalize your experience.
  • Detect, prevent, and respond to fraud, security issues, or illegal activity (including firearms-related violations).
  • Comply with legal obligations, including responding to law enforcement or regulatory requests related to firearms transfers.

3. How We Share Your Information

We may share your personal information in these circumstances:

  • With Sellers and FFLs: Necessary contact and transaction details to complete purchases and legal transfers.
  • Service Providers: Third-party vendors for payment processing, hosting, analytics, email delivery, and identity verification. These providers are contractually obligated to protect your data.
  • Legal and Regulatory Compliance: With government agencies, including the ATF, law enforcement, or courts, as required for NFA compliance, background checks, or to respond to subpoenas.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets.
  • With Your Consent: In other cases where you have explicitly agreed.

We do not sell or share your personal information, and we do not use it for targeted or cross-context behavioral advertising. We do not share data with third parties for their independent marketing purposes.

4. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information. However, no security system is impenetrable. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any suspected breach.

5. Data Retention

We retain your information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations (including firearms record-keeping requirements), resolve disputes, and enforce our agreements. Retention periods vary based on the type of data and legal requirements.

6. Your Rights and Choices

Georgia, where we are based, does not currently have a comprehensive consumer privacy law. However, depending on your state of residence, you may have rights under laws such as the California Consumer Privacy Act (as amended by the CPRA) and comparable laws in states including Virginia, Colorado, Connecticut, Utah, Texas, and Oregon. We extend the core rights below to all users, regardless of location, where reasonably feasible.

Depending on your jurisdiction, you may have the right to:

  • Know and access: Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collection, and the categories of third parties with whom we share it.
  • Correct: Request correction of inaccurate personal information we hold about you.
  • Delete: Request deletion of your personal information, subject to exceptions for legal compliance (including firearms record-keeping), security, dispute resolution, and completion of transactions you requested.
  • Data portability: Request a copy of your personal information in a portable, readily usable format.
  • Opt out of sale or sharing: Opt out of the sale or sharing of personal information and of targeted advertising. We do not sell or share your personal information, and we do not use it for cross-context behavioral or targeted advertising — so there is currently nothing to opt out of. If this ever changes, we will update this Policy and provide a clear opt-out mechanism beforehand.
  • Limit sensitive information: Direct us to limit the use of any sensitive personal information to what is necessary to provide the Services. We do not use sensitive information for any secondary purpose.
  • Non-discrimination: Exercise any of these rights without receiving discriminatory treatment, such as denial of service or different pricing.

How to exercise your rights:

  • Submitting a request: Email us at contact@pieceandquietmarket.com describing your request. We will take reasonable steps to verify your identity before responding, and may decline requests we cannot verify.
  • Authorized agents: You may use an authorized agent to submit a request, provided the agent supplies proof of authorization and we can verify your identity.
  • Timing: We aim to respond within 45 days. If we need additional time (up to another 45 days), we will notify you.
  • Appeals: If we decline your request and your state provides an appeal right, you may appeal by replying to our decision, and we will respond with our reasoning.

Additional choices:

  • Marketing Opt-Out: You can unsubscribe from promotional emails using the link in the message.
  • Account Settings: Update or delete your account information via your dashboard (subject to legal retention needs).
  • Do Not Track: Our Site may not respond to browser "Do Not Track" signals.

7. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies for functionality, analytics, and security. You can manage cookie preferences through your browser settings. Note that disabling certain cookies may limit Site functionality.

8. ATF Form 4 Data Handling

ATF Form 4 (Application for Tax Paid Transfer and Registration of a Firearm) is required for all silencer transfers on our platform. Our role is limited to facilitating the marketplace transaction. We do not collect, store, or submit the full ATF Form 4 on behalf of users.

  • What we collect: Basic purchase-related information such as your name, contact details, selected FFL, and transaction identifiers needed to connect you with the Seller.
  • What we do not collect: Sensitive Form 4 requirements such as fingerprints (FD-258 cards), passport-style photographs, government-issued identification, full SSN, or the complete application package. These are handled directly by the licensed dealer or FFL facilitating the transfer and your chosen receiving FFL (transferee) during the transfer process.
  • Submission process: The selling dealer or the FFL facilitating the transfer prepares and submits the ATF Form 4 (preferably via ATF eForms) directly to the ATF, including any required supporting documents. Your selected FFL may also collect additional information directly from you to complete the transfer and background check (NICS).
  • Sharing: Limited buyer contact and transaction data is shared with the Seller and the FFL(s) involved solely to enable legal compliance and transfer. The completed Form 4 and its attachments are submitted by the dealer or FFL handling the transfer to the ATF and are not stored by Piece & Quiet, LLC.
  • ATF Use: The ATF uses the data for eligibility verification, registration in the National Firearms Registration and Transfer Record (NFRTR), and tax collection. This data is protected under the Privacy Act of 1974 and other federal laws and is not used for marketing.
  • Your responsibilities: You are responsible for providing accurate information to the Seller and FFL and for complying with all ATF, state, and local requirements.

We practice data minimization for NFA-related information and retain it only as long as required by law or for transaction support.

9. Children's Privacy

Our Services are not directed to individuals under 21 years of age (or the legal age for firearms possession). We do not knowingly collect personal information from children. If we become aware of such data, we will delete it.

10. International Users

The Site is intended for users in the United States. If you access from outside the U.S., your data may be transferred to and processed in the United States, which may have different data protection standards.

11. Changes to This Privacy Policy

We may update this Policy from time to time. We will notify you of material changes by posting the new Policy on the Site and updating the "Last Updated" date. Your continued use constitutes acceptance of the revised Policy.
